Brumfield's Babies 'Health Guarantee'

 Breeder guarantees to the best of their knowledge, the puppy is in good health at time of sale, and will provide health records including appropriate vaccinations, worming, and health care until Buyer takes possession of puppy. Breeder is not responsible for what happens to the puppy once the Buyer has possession of puppy. The Buyer agrees to take the puppy to a licensed veterinarian within 3 working days of purchase for evaluation. Should it be determined at this first evaluation that the puppy is suffering from a serious LIFE-THREATENING hereditary condition clearly attributable to the Breeder. This guarantee does not include Parvo and Coccidia. Coccidia can be caused from stress and not necessarily from unclean facilities. Puppies can stress sometimes over going to a new environment. That is why it is very important for your puppy to have a smooth transition into their new environment and allow for enough time for sleeping/eating. So I treat with Marquis from 4 days and every 2 weeks after that until they leave my facility. This is done only as a preventive measure. The Coccidia species in dogs does not infect humans. Canine Parvovirus very contagious and I cannot guarantee against the virus after it leaves my facility. When cleaning daily I use TekTrol and Oxine to prevent all virus and diseases. Buyer must notify the Breeder in writing and provide a statement of diagnosis from their veterinarian; breeder's veterinarian must also confirm and agree to same said condition. The puppy must be returned within 48 hrs. of confirmed diagnosis for a replacement of said puppy only, (see conditions of replacement puppies below). Buyer professionally and willfully agrees to resolve any issues with puppy and all transactions involving the said puppy with the breeder personally (with no type of online bashing of breeder); Buyer agrees all correspondence between buyer and breeder to be limited only to the privacy and discretion of breeder and carried out in a peaceable manner. Any rudeness, defamation, or bullying of character will void this contract and can result in legal proceedings.

CONDITIONS OF REPLACEMENT:

*** No replacement will be given for a returned dog that has suffered abuse or neglect. The BREEDER is committed to raising sound, healthy, loving Companion and Toy Breeds.**

In addition to the veterinarians statements provided by Buyer as listed above, replacement conditions are as follows: The dog must not have whelped or sired a litter after placement with the buyer. Full veterinary history of pup will be provided to the Breeder, available through email or mail in 7 day limit. Buyer will also provide open communication between breeder and buyer. Dog must be fed quality feed and vitamins to support small breed health, receipts of this to prove this from time of possession provided by buyer.

The replacement puppy will be of approximate equal quality, not limited to color. Under no circumstances will cash/money be refunded. Replacement puppy will take the place of original said puppy with condition, and original said puppy will be returned to breeder. If Buyer chooses to not comply with these conditions, Buyer acknowledges Brumfield's Babies ‘Health Guarantee’ and ‘Sales Contract’ will no longer be valid and will become null & void; Breeder will then be released from any further obligations and claims.

All transportation and/or shipping costs on the replacement puppy are borne by the Buyer. Shipping costs may include, but are not limited to, Veterinary Health Certificates and vaccinations required for interstate travel, crate purchase, and actual shipping costs. The final decision to replace a puppy and the timing of such a replacement, is at the discretion of the Breeder; puppy replacements are generally expected to be fulfilled within 12-months of discovery of initial life-threatening genetic issue. By not abiding by all conditions in this contract, Buyer agrees this contract is Null/Void with no further actions pursued, and any/all further claim or transaction between Buyer and Breeder will no longer be valid.

If you have made a deposit on a puppy and we, Brumfield's Babies, are trying to contact you and you do not respond to us, Brumfield's Babies, with in five days of our first attempt to contact you, your deposit will be lost and the puppy will be put back up for sale. Filling out this contract does not hold a puppy, you need to send a deposit to hold a puppy. If you send a deposit before filling out our, Brumfield's Babies, sales contract it will be as if you did fill the sales contract. You must fill out our sales contract in order to purchase one of our puppies. If sale pending has been written on a puppy's picture for you, you have one day to confirm how you will be making your payment/deposit. If no payment is received in five days from then, then the puppy will be put back up for sale. The puppy must be picked up within 2 weeks of the "Estimated Availability Date" for the puppy being purchased. Brumfield's Babies is not a boarding facility and can not hold on to the purchased puppy after they are ready to go to their forever home. If for some reason you are not able to pick up your puppy once they are 8 weeks old and ready to go, we will charge $20 every week that they are not picked up. If you do not pick your puppy up within 2weeks of the "Estimated Availability Date" for your puppy, your payments and deposit will be lost and we will put the puppy back up for sale. When shipping a puppy, we will ultimately pick the international airport that the puppy will be shipped too, regardless of your preferred choice, if the travel/connection time will be shorter at one of the next closest international airports. On the terms of returning a puppy, if the puppy is healthy and has no life threatening problems, no money will be refunded. The buyer understands that by filling out this contract with their name and submitting it is the same as signing it in person. This agreement is a binding contract in the state of Tennessee and is the entire agreement between the buyer and Tammy Brumfield/Brumfield's Babies concerning the health conditions and/ or loss of this puppy. Any litigation commenced shall take place in the White County Tennessee Court System. Submitting this contract means that the buyer has read and understands in full the entire agreement of this contract. No puppy is to be sold without the buyer submitting Brumfield's Babies contract.
